New Jersey Traffic Ticket & DWI Attorneys
Fighting Your Traffic Ticket
Fighting your speeding ticket, red light ticket, or other moving or traffic violation begins with an understanding of the consequences that go with the charge.
CARELESS DRIVING – NOT AS SERIOUS BUT STILL COSTLY
While careless driving is not as severe as reckless driving, the consequences are still expensive.
If you plead guilty to careless driving, New Jersey will place 2 points on your license. If you experience additional offenses, the points could accumulate which lead to suspension of license.
Also, your insurance company will consider you a higher risk for accidents and raise your insurance premiums.
RECKLESS DRIVING – A VERY SERIOUS OFFENCE
If you are found guilty of reckless driving, you can be arrested, fined and sent to jail. Someone who is convicted of reckless driving is perceived to be someone who disregards the safety of others. In other words, you intentionally put others at risk through your reckless behavior.
MOTOR VEHICLE POINTS, POINTS, POINTS
Most moving violations carry both motor vehicle points and insurance points. Motor vehicle points are assessed by the NJ Motor Vehicle Commission and weigh against your license.
Insurance points are assessed by the insurance companies to a particular type of summons. These points weigh against your insurance premiums.
But, the points are not all you are facing. The courts are authorized by statute to assess fines and surcharges against you, and, under certain circumstances, may even revoke your driving privileges.
Simply stated, you cannot make a decision as to which course of action is best for you until you understand fully the ramifications of the traffic violations you are facing.
FORMULA TO BEAT A TRAFFIC TICKET
Once you understand the penalties, you need to fully comprehend the charge. Every traffic ticket has certain elements that need to be proved in order for you to be found “guilty.” If the prosecutor cannot prove, beyond a reasonable doubt, each and every one of these elements, you will succeed in fighting the ticket.
In court, you will have an opportunity to confront the elements of the charges with evidence of the facts and circumstances that challenge and raise doubts as to those necessary elements. Therefore, knowing the elements of each traffic ticket you are fighting is crucial to your success.
Lastly, understanding which challenges to the elements will succeed and which will be more suited to negotiations is the difference between “not guilty” and a “guilty” verdict.
Some facts, although insufficient to win a fight against a traffic ticket, may, nonetheless, provide a strong negotiating position for a reduced and far more favorable charge.
All of the above sounds simple; but, judges, prosecutors, and defense attorneys have spent entire careers defining and re-defining the elements of traffic violations and successful challenges to them.
